On Wednesday – September 19th, 2012 at approximately 1748 hours, the Murrieta Police Department received a call for service in regards to a male adult subject who had just exposed his genitals in a sexual manner to an unsuspecting female adult victim. This incident took place in the 40000 block of North End Road, Murrieta. A description of the male subject was provided and was later pointed out to the police officers as they arrived on scene.
The female was desirous of prosecution and requested the male subject be placed under arrest for the indecent exposure. Incident to the arrest, officers located a falsified California driver’s license in the subjects’ possession. It was suspected by the officers that this subject was an undocumented illegal immigrant. Therefore, the U.S. Border Patrol Office was contacted and assisted in this investigation.
This subject was identified as Emelio Gomez-Penaloza (a 46-year-old resident from Homeland). Mr. Gomez-Penaloza was placed under arrest per 314(1) PC – Indecent Exposure and 529.5(c) PC – Possession of a false driver’s license, along with an “immigration hold”. Mr. Gomez-Penaloza was then transported to the Southwest Detention Facility to complete the booking process.
